MUST RETURN THE UNEMPLOYMENT MONEY?

 

This January many people will receive a notification, that money from unemployment received during the Covid-19 Pandemic, will have to be return. This is due to many people took the wrong path, either because they lie to get it, or they just simply report it and took it while they were working.


First we must understand that in order for you to have to return the unemployment money, you must have to be accuse of fraud. which is a Federal crime and if this happens you may not only have to return the money but also face penalties consequences and even jail time.

Some Examples of this type of fraud are:

  • Give false information when you apply the first time to get the unemployment benefit. This could be like you say it the wrong reason why you were fired from your last job.
  • Work meanwhile you receive unemployment benefit, this part have some limitations because you can actually have 2 jobs and collect unemployment but are some rules that have to be follow in order not to not to be in trouble, you must follow the guidelines. You must said that you still are working and report the amount received and the days worked at the remaining job. the system will calculate for you, how much are you entitle.
  • Work any amount of time and deny that you worked, so you can get the whole benefit amount, while certifying.
  • Earn more than $504.00 in any giving week and states that you did not earn it.
  • NOT to be WILLING, READY and ABLE, to work, but state that you are.
  • Been out of the country and certify while you are not in the USA.
  • Work out the books and collect the unemployment while stating that you are not working.
  • Steal another person Identity and collect unemployment for that person
  • Help another person to commit fraud to steal money from the unemployment insurance.
  • Help an employer to illegally commit fraud and both collect the unemployment insurance.
Any person that is discovered committing fraud with the unemployment money will have to return the money received, you will face penalties consequences and depending on the case you will face jail time. This a federal crime. Take into consideration the examples above, but not all is limited to those only, because scams can come in all form and shape.

Now that we know what NOT to do, now we must know what TO DO. If you are planning to travel and you will not be ready willing and able in that week, well just certify that, stating that you were not ready for work those days you were out the country. You can choose not to certify in that week which is easier, the Department of labor will not ask, about your private life. 

Another way of fraud is to ask an employee to collect unemployment together with the employer while working on the same place out of the books and split the money with the employer. this type of practice is very common in small business. Because corporations do not pay their employees out of the books.

At the end if you work just say it and stop trying to be smarter than the government for a couple dollars is not worthy, if you will not get any unemployment in that week, cause you worked so be it.

FREE NOTARY PUBLIC SERVICES NEAR ME

 If you are in New York City then at least once every 2 years you will need the services of a Notary Public, to witness and legalize a signature. Even in most cases a Notary Public Signature cost $2.00, but you can even get that service for free if you go to your local bank, if you have a bank account in good standing with them, they may help you for free or go to your tax return preparer and if he/she decide to help you for free, then he/she will do it, cause you do your taxes with that person but is not always the case. Another way is go to your local police precinct, some times they have a notary public officer available that can help you for free, in this one I will advice you to call the precinct first to make sure is available.

If you see a pattern here you will note that in most of the cases, you must call before you go or is not guaranteed that the notary will be available, this is due to the fact that nobody wants to work or get more work for free or little money.

The only problem with the so called free notary public is that they are virtually almost impossible to get, and at the long run is time consuming and at the end you ended up wasting more valuable time than the amount that you will spend, just if you just decide to pay extra, so he/she can compromise and do the required job for you.

Lets make some sense here, and review this examples.

EXAMPLE 1: You need to notarize a document next day and is past 5:00PM weekdays, your possibilities to get a notary public available is only 20% if you are lucky enough, but is pass 7:00pm then your possibilities are almost 1%. and what will happen to the document if is not submitted on time, of course every case is different, but a lock rate for a loan could mean thousands of dollars, a financial aid application for your kids college, could mean that your child do not get financial aid for college. is a lot of different consequences, depending on the rules or the type of document and what for is needed. Imagine this happens on weekends. Now you do the math and get serious.

EXAMPLE 2: Imagine that you are traveling with your children on vacation and the plane leave next day early in the morning, but one of the parents is not going, you will need a minor travel parent consent, so your child can board that plane. If is past 5:00PM and you did not get a notary public for that consent, your children will not board the plane unless you hire a mobile notary public to help you after hours.

EXAMPLE 3: all notarized documents, must be sign in presence of the notary public (in person) after the notary verify the ID, what happen if the signer can not go to the notary, because is in the hospital or nursing home or home and unable to travel, then your only choice will be to hire a mobile notary public to go to you. Now the question is this, what are the possibilities of you getting a mobile notary public that goes to you for free or for $2.00 only. Well sorry but they are (ZERO %), now another question is what will be the consequences if that person do not sign an important document like a will, testament or power of attorney, and that person past away or is incapacitated to act on her own behalf? Just think about this for a minute.

EXAMPLE 4: is raining or snowing, and day looks what some people call weather horrible, just a heavy rain will suffice for this term, Do you really want to go around the neighborhood looking for a notary public, with papers on your hand during a rainy or snowy day, just to get it done for free? what are the possibilities that those documents get wet and damage before or after the signature?

EXAMPLE 5: You skip work, will arrive later during the day or will miss school to get this papers done, if the company pays you per hour, then you lost the time invested, if you work in New York City then the minimum wage is $15.00 an hour, so if you invested 3 hours on this, you just loss, $45.00, but that is not all, what happen if you then do not find a notary and have to take another day off, this will increase the amount of money you just loss, almost to double.



Let's get real, in most cases the value is related to the type of service you receive, the more you pay the more guarantee and better service you will receive. If you don't pay, you can not complaint. If you paid too little then you can complaint just too little. and your guarantees are correlated to the same amount. 

Now an alternative and solution to this problem, is to hire a Mobile Notary Public, this person usually works around the clock on appointments only and visits clients at they residence or location. This mobile notary public, may charge you a higher fee do to the traveling and odds time of the appointment, but in most cases is not even that much in relation to the time invested by you skipping work, remember loss time can not be recuperated and the good thing is you will have your document done at your convenience, you will not interrupt you normal life to take care of the document. Some of them accept all type of forms of payments, from cash, to direct deposit, to Credit Cards. Make sure to ask for credentials before start any negotiation.
